Many workers experience on-the-job accidents. In 2018, there were 2.7 million private industry injuries and illnesses, more than 700,000 in the public service sector and around 4,500 victims of fatal work-related accidents (from United States Bureau of Labor Statistics). Most of the reported injuries affected first responders and healthcare workers, and those working construction, manufacturing, transportation, warehousing, and food service. But workplace injuries and illnesses can happen to anyone. The good news in a bad situation is that your employer may be liable for your injuries.
In New Jersey, as a general rule, you cannot file a civil lawsuit against your employer or co-worker when you are injured on the job or develop an occupational illness. However, employers are required to obtain Workers’ Compensation insurance which provides an injured worker with certain benefits.
WHAT IS WORKER’S COMP?
You may have heard the term “workers’ compensation” before but be unaware of the process involved. All employers are required to maintain insurance protection, or provide qualified self-insurance, for their employees to provide them with benefits in the event of a work-related accident or illness.
Through a workers’ compensation claim you may be entitled to compensation for:
- Medical costs and expenses for reasonable and necessary treatment,
- Lost wages if you suffer a temporary disability,
- Permanent disability, and
- death benefits for your survivors in the case of a fatal injury.
We are here to guide and support you through the workers’ compensation process from initial injury to compensation.
